Swan CPR Privacy Policy, Terms, and Conditions

Please read these Terms & Conditions (“Terms”) carefully before using https://www.swancpr.com (“Site”). Swan CPR is a trade name (dba) of The Swimming Swan, LLC.

1. Acceptance of Terms

By accessing or using the Site you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. Scope — Website Use Only

These Terms govern your use of the Site (content, features, and online services). They do not govern enrollment in classes, course registration, or other training-specific terms, which are governed by separate agreements presented at registration or on the FAQ/registration pages.

3. Changes to Terms

We may modify these Terms at any time. We will post changes on the Site with a revised effective date. Continued use of the Site after posting constitutes acceptance.

4. Site Access & Account Registration

Some features may require account registration. You agree to: provide accurate information, keep account credentials secure, and be responsible for all activity under your account. We may suspend or terminate accounts for violations of these Terms.

5. Acceptable Use

You agree not to:

  • Use the Site for illegal purposes or to violate laws or third-party rights;
  • Interfere with or disrupt the Site, servers, or networks;
  • Attempt to gain unauthorized access to systems or data;
  • Upload or transmit viruses or harmful code;
  • Impersonate others or submit false information.

We may investigate and take action against violators.

6. Intellectual Property

All content on the Site (text, graphics, logos, images, software, course descriptions and other materials) is owned or licensed by The Swimming Swan, LLC or its licensors and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute, create derivative works, publicly display, or commercially exploit Site content without our express written permission.

7. User Content

If you post, upload, or submit content to the Site (reviews, comments, images), you represent that you own or have the right to use that content and grant Swan CPR a perpetual, royalty-free, non-exclusive, worldwide license to use, reproduce, modify, publish, and display that content for Site operation and promotion. We may remove or refuse content that violates these Terms.

8. Links to Third-Party Sites

The Site may link to third-party sites. We are not responsible for external site content, privacy practices, or terms. Links do not imply endorsement.

9. Disclaimers

The Site and all content are provided “as is” and “as available.” We expressly disclaim all warranties to the fullest extent allowed by law, including merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be error-free, secure, or uninterrupted.

10. Limitation of Liability

To the maximum extent permitted by law, The Swimming Swan, LLC and its officers, employees, agents and licensors will not be liable for indirect, incidental, consequential, special, punitive or exemplary damages, or for loss of profits, data or goodwill, arising from your use of the Site, even if advised of the possibility of such damages. Our aggregate liability for direct damages will not exceed the fees you paid us in the 12 months preceding the claim (or $100 if no fees were paid).

11. Indemnification

You agree to indemnify and hold The Swimming Swan, LLC (and its affiliates, officers, directors, employees, agents and licensors) harmless from any claims, liabilities, damages, losses and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your use of the Site.

12. Termination

We may suspend or terminate access to the Site at any time for any reason, including your breach of these Terms. Provisions that by their nature survive termination (Intellectual Property, Indemnification, Disclaimers, Limitation of Liability, Governing Law) will survive.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any legal suit or proceeding shall be brought exclusively in the state or federal courts located in San Diego County, California.

14. Miscellaneous

Severability: If any provision is held invalid, remaining provisions will remain in effect.

Waiver: Failure to enforce a right is not waiver of that right.

Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Swan CPR regarding Site use.

15. DMCA & Copyright Policy (Notice & Takedown)

If you believe copyrighted material is posted on the Site without authorization, provide a written DMCA notice to the designated agent with details sufficient to locate the material. Our agent will respond per the Digital Millennium Copyright Act.
